A mother has filed a lawsuit claiming her child was sexually
assaulted on a school bus and claims that the school was negligent in the incident.

The alleged assault happened two years ago but the lawsuit wasn't filed until earlier
this week. It claims that a 21-year-old student at Oak Hill School in Tuscaloosa fondled
and sexually assaulted an 11-year-old girl while on the bus. At the time, both attended
the school and suffer from mental and or physical disabilities.

There are three people named in the suit: the bus driver, the bus aid and the director of
transportation services. The lawsuit alleges that security cameras on the bus weren't
working, but kids on the bus took cell phone pictures of what happened; the boy allegedly
fondled and sexually assaulted the girl, which left her bloody with cuts to her face and a
missing tooth; and that the victim's disability makes it difficult for her to talk, let alone
defend herself.

"There needs to be a growing concern for taking care of those with special needs and
special abilities. There's a higher degree of care that's necessary," Clint Mountain,
the victim's attorney, said.

The Tuscaloosa City School system is not named in the suit. A school spokeswoman
declined to comment other than to say one of the three people named in the suit has
retired and no longer works for the school system.
